1.1 The sale of products offered on the website www.dettosante.it (hereinafter referred to as the “Site”) is governed by the following General Contract Conditions (hereinafter referred to as the “General Conditions”).

1.4 The purchase contract and related procedures are available in Italian and English.

2 BASIC INFORMATION

2.1 Calzature Detto Sante SNC reserves the right to make changes or additions to these General Conditions at any time, by publishing them on the website www.dettosante.it . In any case, the customer will be bound exclusively by the General Conditions in the text in force on the date on which the purchase order is placed.

2.2 By sending the purchase order, the customer acknowledges having carefully examined and fully accepted these General Conditions, which can be viewed at any time. In this regard, Calzature Detto Sante SNC recommends that the customer download, save or print the General Conditions in force at the time the purchase order is sent.

2.3 To place a purchase order, it is not necessary to register on the Site, but it will be necessary to accept, by selecting the appropriate box, the General Conditions of Sale. Failure to accept the Conditions themselves will make it impossible to proceed with the purchase of the Products . The customer guarantees that the personal information provided during the purchase procedure is truthful.

3 PURCHASE PROCEDURE

3.1 Each product selected by the user of the Site can be viewed on a specific web page which contains the description, photographic images and highlights the unit price (including VAT in the amount determined by the legislation of the State of reference), the colours and the different sizes or measurements available.

3.2 Each sale made by Calzature Detto Sante SNC via the Site may concern one or more products, without limits on quantities or maximum spending limits.

3.3 The customer, by choosing the items of interest, will include such products in his/her Cart. In the same Cart, a brief summary description of the selected products will be displayed, including the measurements or sizes, together with one or more photographic images in digital format that allow an adequate representation of the products. It is understood that in the event of discrepancies between the photographic images and the summary description, the latter will prevail and will be considered indicative of the purchased product.

3.4 The customer is required to verify the accuracy of the contents of the Cart before confirming the order , completing the online purchase order form according to the instructions for the purchase procedure provided on the appropriate page of the Site and confirming that he has read and accepted these General Conditions. Once the accuracy of the data relating to the chosen Product/s has been verified, the Customer must choose the payment method referred to in art. 5.

3.5 The purchase procedure is completed when the customer selects the “Confirm Purchase” option on the order summary page displayed upon completion of the relevant procedure. At this time, the order is sent directly to Calzature Calzature Detto Sante SNC to be processed and cannot be further modified or cancelled.

3.6 By sending the order, the customer confirms acceptance of the provisions of these General Conditions.

3.7 The purchase order will be archived at the Calzature Detto Sante SNC data center and the customer will be able to follow the status of his order online in the reserved area of ​​the Site “My Orders”.

3.8 The customer will also receive an order confirmation email, to the address provided in the online purchase order form, containing a summary of the main contractual conditions and the link to the complete document of the applicable General Conditions.

3.9 Although Calzature Detto Sante SNC constantly adopts measures to ensure that the photographs shown on the Site represent the most faithful reproduction possible of the real products, it is always possible that some discrepancies may occur due to the technical characteristics and the quality of color resolution of the terminal or screen used by the customer. As a result of the aforementioned technical reasons, Calzature Detto Sante SNC assumes no guarantee and responsibility for the absolute accuracy of the graphic representations of the products shown on the Site.

3.10 Calzature Detto Sante SNC reserves the right to refuse purchase orders from a customer who it deems unfit to fulfill its obligations, such as in the case of, for example, a previous violation of the contractual provisions for online purchases via the Site. In any case, it is understood that all purchase orders sent constitute contractual proposals and that the conclusion of the contract is left to the discretion of Calzature Detto Sante SNC, which is free to accept or refuse orders.

4 AVAILABILITY

4.1 The customer acknowledges that the stocks of the products offered by Calzature Detto Sante SNC through the Site are limited. The Site displays the products considered available for purchase by customers. Occasionally, inconveniences may occur regarding the availability of certain products without this entailing any liability of Calzature Detto Sante SNC towards Customers. In such circumstances, the customer will be informed of this fact as soon as possible (and in any case within the delivery terms specified below) by e-mail or by telephone; consequently, the incomplete order will be cancelled and the customer will be offered the possibility of placing a new order by telephone or directly by accessing the Site again. Cancellation of the entire order will not entail any charges to the customer.

4.2 Calzature Detto Sante SNC reserves the right to change or update the products offered on the Site at any time, without notice.

5 PRICE AND PAYMENT METHODS

5.1 The prices of all products offered for sale on the Site are expressed in Euros (€) and are inclusive of VAT at the rate in force in Italy (currently 22%) if the Products are shipped by Calzature Detto Sante SNC and delivered within the European Union.

5.2 The price does not include shipping costs. Calzature Detto Sante SNC reserves the right to request a contribution from Customers for shipping costs which may vary depending on the type of delivery, the quantity of products to be delivered, their weight and their destination.

5.3 The contribution requested by Calzature Detto Sante SNC for shipping costs is indicated, separately from the Price, before the order is sent by the Customers and will be paid by the Customer together with the payment of the price.

5.4 The total amount, together with the shipping costs to be paid by the customer, if applicable, as specified below, will be highlighted in the Cart and on the order summary page displayed upon completion of the relevant procedure.

5.5 Calzature Detto Sante SNC reserves the right to change the prices of the products offered for sale on the Site at any time and without notice. The customer will be charged the prices published on the Site at the time the order is sent by the customer, without prejudice to the provisions of art. 4.1 in the event of unavailability of the products.

5.6 Calzature Detto Sante SNC accepts only payments made via:

  • credit card;

  • PayPal;

  • Satispay;

  • Bank transfer;

  • Postepay top-up;

  • mark.

     Calzature Detto Sante SNC accepts the credit cards indicated on the relevant page of the Site.

  • 5.7 In case of payment by bank transfer, Customers must make the transfer to the bank details indicated on the Site, specifying in the reason for payment the order number reported by Calzature Detto Sante SNC . at the time of sending the Order confirmation.

  • 5.8 The shipment of the products takes place exclusively after the verification of the customer's credit card data. The customer's credit card will be charged exclusively after the fulfillment of the relevant order. The credit card data sent during the placing of the Orders are protected and are sent directly to the banking company that manages the payments that take place directly on a secure server in order to guarantee the absolute security of the transaction.

    5.9 In case of payment via PayPal, at the time of sending orders by customers, the Web session will be transferred to the PayPal website. On this website, customers can complete the payment of the Price and any contribution for shipping costs using their PayPal account and according to the conditions of use of PayPal services. The debit of the price and shipping cost to the PayPal account occurs together with the sending of the order confirmation by Calzature Detto Sante SNC

     5.10 The commercial receipt will be sent together with the goods present in the package(s). To request the

    commercial invoice instead it will be necessary to send a request via e- mail to the address info@dettosante.it 5.11 In the event that one or more products are not available, the customer will be contacted by telephone

    as established in art. 4.1.

    6 LIMITATIONS IN DELIVERY OF PRODUCTS

6.1 Deliveries are made exclusively in all member countries of the European Union, USA, Canada, Brazil, Argentina. The products will be shipped to the postal delivery address indicated by the customer in the online purchase order form.

6.2 Calzature Detto Sante SNC will not ship any order addressed to a PO box nor will it accept any order in which it is not possible to identify the person who placed the order, the recipient of the products ordered or the delivery address.

7 DELIVERY METHODS

7.1 Calzature Detto Sante SNC uses the couriers TNT, Poste Italiane, BRT and DHL for the shipment of orders. The Products that are available in the warehouse will normally be delivered in the shortest possible time and in any case, indicatively:

  • in Italy, within 3 working days of receiving payment.

  • in EU countries other than Italy and in other countries, within 5-7 working days from receipt of the

    payment.

    7.2 Shipping costs can be viewed by the customer, together with the total price for the purchase of the products, before confirming the order, in the Cart and on the purchase order summary page.

    7.3 The Seller undertakes to do everything in its power to respect the delivery times indicated on the Site and, in any case, to make the delivery within a maximum of 30 (thirty) days starting from the day following the day on which the order was sent by the Customer. If the customer has chosen bank transfer as the payment method, the delivery term will start from the receipt of the payment by the Seller.

    7.4 In the event of problems or delays in delivery exceeding 10 (ten) working days following the date indicated in the order confirmation email referred to in art. 3.8, customers are required to report the fact to the email info@dettosante.it using the Contacts section on the Site.

    7.5 The customer undertakes to check as soon as possible that the delivery includes all and only the products purchased and to promptly inform Calzature Detto Sante SNC of any defect in the products received or their non-conformity with the order placed according to the procedure in point 9 below; otherwise the products will be considered accepted. If the packaging of the products should arrive at its destination clearly damaged, the Customer is invited to refuse delivery by the carrier or to accept delivery "with reservation".

    8 WITHDRAWAL AND RETURN

    8.1 The customer has the right, pursuant to and for the purposes of art. 64 of Legislative Decree no. 206/2005, to withdraw from the sales contract, without specifying reasons, within 14 (fourteen) days from the date of delivery of the products, without any penalty.

    8.2 Furthermore, the customer is guaranteed the right to return the products, which can be exercised within the same time frame provided for the right of withdrawal for one of the reasons reported on the Site in the “Withdrawal/Return Procedure” section.

    8.3 To exercise the rights provided for in articles 8.1 and 8.2, the customer must complete the online Return Form, specifying in the case of a return the reasons for the return and the quantity of items that the customer wishes to return. The online Return Form must be completed according to the “Instructions” contained in the “Withdrawal/Return Procedure” section of the Site.

    8.4 Following the electronic completion of the online Return Form according to the “Instructions for the Withdrawal/Return Procedure”, Calzature Detto Sante SNC will provide the customer with the return code to indicate for the return shipment.

8.5 In the event that customers exercise the right of withdrawal/return referred to in this article: (i) customers undertake in any case to return the products within 10 days from the date of exercising the right of withdrawal/return; (ii) the shipping costs associated with the return of the products are borne by Calzature Detto Sante SNC only if the customer complies with the instructions provided in the "Withdrawal/Return Procedure" section of the Site" and for all orders over €120; (iii) Calzature Detto Sante SN C. undertakes to refund the price as quickly as possible, and in any case within 30 days from the date of receipt of the returned products, provided that they have been returned in their original condition, intact and unused, together with the original packaging/wrapping and any accessories, quality labels, instruction manuals.

8.6 All refunds processed by Calzature Detto Sante SNC will be made with the same payment method used to place the order or by bank transfer.

8.7 Calzature Detto Sante SNC will not give rise to any refund of the price if customers exercise the rights of withdrawal/return in a manner that does not comply with the methods and terms set out in the Withdrawal/Return Procedure and this article.

8.8 Calzature Detto Sante SNC will verify whether the returned products are actually in their original condition; if the products returned by the customer are damaged, incomplete, deteriorated and/or dirty, they will not be refunded. The right of the same to request compensation for any damage or non-correspondence with the products delivered to the customer remains intact. If the return of the products for withdrawal or return is entrusted to a carrier other than the one indicated by Calzature Detto Sante SNC, the latter will not be responsible for the loss of products, shipments to incorrect addresses or delays in the delivery of products, it being understood that the customer assumes all risk of such shipment.

8.9 In the event of a return request, Calzature Detto Sante SNC reserves the right to offer the customer products to replace those returned of the same amount.

9. DEFECT OF CONFORMITY

9.1 Upon delivery, the customer must check the products to ensure that they correspond to the items ordered. Any anomalies found upon delivery (for example, tampering or damage to the packaging, damaged products, missing items, etc.) must be indicated on the delivery document in the form of an express reservation signed by the customer.

9.2 If the products do not correspond to those ordered, the customer is required to promptly inform Calzature Detto Sante SNC via Customer Service and has the right to demand the execution of the order, after returning what was received, or, in the event of subsequent unavailability of the products ordered, to order different items of the same nature or, alternatively, to be reimbursed for any damage .

9.3 Calzature Detto Sante SNC is also responsible in the event of a lack of conformity of the products, provided that the customer presents the complaint within a maximum of 7 (seven) days from the date on which he discovered the defect.

9.4 In the event of non-conformity of the products, the customer will have the right to obtain their restoration without costs, through repair, replacement or coupon.

9.5 The costs incurred by the customer for the return of products found to be defective or non-compliant will be borne by Calzature Detto Sante SNC

10 LIMITATION OF LIABILITY

10.1 Calzature Detto Sante SNC will not be liable in any way towards the customer as a result of (i) damage or loss caused by the products or their use by the customer (without prejudice in any case to the application of the mandatory rules regarding the manufacturer's liability); (ii)

damages that are not caused by non-fulfilment by Calzature Detto Sante SNC; (iii) loss of business or commercial opportunities.

11 PRIVACY

11.1 All personal data are treated with the utmost confidentiality according to the directives contained in the “Privacy Policy”, which can be viewed in the appropriate section of the Site.

12 APPLICABLE LAW

12.1 These General Conditions are governed by Italian law and will be interpreted in accordance with it, with the exclusion of the 1980 Vienna Convention on international sales.

12.2 For any dispute that may arise in connection with the General Conditions and/or the Sales Contracts, the court of Ascoli Piceno will have exclusive jurisdiction.
